The case is expected to be similar to previous federal cases in which Bannon was indicted but not charged because Trump pardoned Bannon before he was indicted.
Bannon and others have been accused of scooping money from donors for personal use, including travel and credit card debt.
The original federal lawsuit had three co-defendants. Two pleaded guilty and another of his failed the trial.
Bannon will turn himself in to New York authorities on Thursday, according to a person familiar with the New York case. This makes him a member of a large and growing group of former top Trump associates who are having trouble with the law.
The New York indictment comes just months after Bannon was found guilty of contempt of Congress for refusing to comply with a subpoena by a House committee investigating the January 6 attack on the U.S. Capitol. was broken
